Final ORV rule issued

The National Park Service (NPS) announces that the final rule document for the management of off-road vehicle (ORV) use at Cape Hatteras National Seashore (Seashore) has been posted for viewing on the Federal Register Public Inspection web page under “Regular Filing.”  The rule can be found at: http://www.federalregister.gov/public-inspection.

The final rule will be published in the Federal Register on Monday, January 23, and become effective on Wednesday, February 15, 2012. The rule designates off-road vehicle (ORV) routes and authorizes limited ORV use within Cape Hatteras National Seashore (Seashore) in a manner that will protect and preserve natural and cultural resources, provide a variety of safe visitor experiences, and minimize conflicts among various users. Under National Park Service (NPS) general regulations, the  peration of motor vehicles off of roads within areas of the National Park System is prohibited unless authorized by special regulation.

The rule establishes, among other things, the requirement to have an ORV permit to operate a vehicle on designated ORV routes at the seashore. The NPS will provide additional information to the public about how to obtain an ORV permit prior to February 15.

Final access report noted

This is the final weekly beach access report for the 2011 season at Cape Hatteras National Seashore. We anticipate there will be very few additional significant changes in access since Hurricane Irene reduced the number of sea turtle nests remaining on seashore beaches. Any significant changes in  access that occur this fall or winter will be reported in a press release, as needed. Minor adjustments in access will simply be reflected in periodic updates of the Google Earth map.

Beach and soundside access throughout the Seashore:
-Ramps that are open to pedestrian and ORV access: Ramps 2, 4, 27, 30, 34, 38, 43, 44, 45, 49, 55, 67, 70, and 72
-Ramp 1 is open to pedestrian access but closed to ORV access -Ramps 59 and 68 remained closed to ORVs pending repairs from storm damage
-Seasonally closed beaches in the Tri-Villages (Rodanthe/Waves/Salvo) area will remain closed to ORVs and Ramp 23 is closed to entry at the
request of Dare County until normal visitor access is allowed back into those villages
-From September 16 to November 15, night driving from 10 p.m. to 6 a.m. for ORVs on any open and accessible beaches is allowed with a valid, signed permit. The permit must be in plain view on the dashboard of the vehicle. The free permits are available at NPS visitor centers and ranger stations, local tackle shops, and on-line at: http://www.nps.gov/caha/planyourvisit/off-road-vehicle-use.htm

 -Most of the established soundside access areas in the National Seashore are open to pedestrian or ORV access

On-site signage provides the most accurate and current indication of public use restrictions or closures. Knowledge of tidal changes and rough surf conditions is important, as some beach areas may be inaccessible at high tide. Caution should be exercised while traveling the beaches of the park

ORV comment period reopens

The National Park Service is reopening the public comment period for the proposed rule to manage off-road vehicle use at Cape Hatteras National
Seashore in North Carolina. The additional comment period allows more time for those who may have been affected by Hurricane Irene to submit comments.

Bodie Spit reopens to ORVs

Superintendent Mike Murray has announced the reopening of Bodie Island Spit to off-road vehicle (ORV) use as the shorebird nesting season comes to
a close in Cape Hatteras National Seashore.

 On Bodie Island Spit, the shoreline access corridor south of Ramp 4 to Oregon Inlet reopened to ORV and pedestrian access on Wednesday, August 16, 2011. As a reminder, the nighttime restriction on beach driving is still in effect on all National Seashore beaches from 10 p.m. to 6 a.m.

Beach access report for Aug. 11

The National Park Service announces its beach access report for Aug. 11-17 as follows:

Ramp 1 – Ramp 2 (Coquina Beach Area) (1.2 miles)
Status: The beach is open for pedestrian access, but not for ORV access.

Ramp 2 – Ramp 4 (2.4 miles)
Status: Ramp 2 is closed for ORV access. North of Ramp 4, the beach is open for ORV and pedestrian access for approximately 2.4 miles.

Ramp 4 – Oregon Inlet (Bodie Island Spit: 2.0 miles)
Status: The beach is open to ORV and pedestrian access south of Ramp 4 for approximately 0.3 of a mile. A pedestrian only corridor extends south for an additional 0.2 of a mile of oceanside access. A resource closure on the ocean shoreline precludes ORV and pedestrian access to Oregon Inlet.

Hatteras Island (Ramp 23 South to Hatteras Inlet; 42.8 miles of ocean shoreline)
Mileage Summary: 20.0 miles open to ORVs and pedestrians; 17.4 miles open to pedestrians only; 2.9 miles of “limited access;” and 2.5 miles closed to public access due to resource closures.

Villages of Rodanthe, Waves, and Salvo – Ramp 23: (Pea Island NWR boundary to Ramp 23 – 3.0 miles)
Status: The beach in front of the villages of Rodanthe, Waves and Salvo is closed to ORV access. The annual seasonal village closure is in effect from May 15 through September 15, 2011. The beach in front of
the villages is open for pedestrian access for 3.0 miles. The beach is open to ORV and pedestrian access for 0.3 of a mile north of Ramp 23.

Ramp 23 – Ramp 27: (4.3 miles)
Status: The beach is open to ORV and pedestrian access for 2.0 miles south of Ramp 23 where two full beach closures for sea turtle nest protection areas preclude through ORV and pedestrian access. There is approximately 1.6 miles of “limited access” between the two closures.

Ramp 27 – Ramp 30: (2.1 miles)
Status: Ramp 27 is closed to ORV access and pedestrian access. There is ORV and pedestrian access for 0.1 miles north of Ramp 30 where a full beach closure for a sea turtle nest protection area precludes access.

Ramp 30 – Ramp 34: (4.3 miles)
Status: The beach is open to ORV and pedestrian access for 3.4 miles south of Ramp 30 and 0.7 of a mile north of Ramp 34. A full beach closure for a sea turtle nest protection area precludes through ORV and
pedestrian access.

Ramp 34 – Ramp 38: (3.9 miles)
Status: The beach in front of Avon Village is closed to ORV access. The annual seasonal village closure is in effect from May 15 through September 15, 2011. The beach in front of Avon Village is open for pedestrian access for 3.9 miles.

Ramp 38 – Ramp 43: (6.0 miles)
Status: The beach is open to ORV and pedestrian access for 2.2 miles south of Ramp 38 and 0.4 of a mile north of Ramp 43. There is pedestrian access 1.0 mile north of Buxton Village and from Buxton Village beaches south for approximately 2.8 miles to Ramp 43.

Ramp 43 – Ramp 44: (0.4 of a mile)
Status: The beach is open to ORV and pedestrian access for 0.3 of a mile south of Ramp 43 where a closure for a sea turtle nest protection area precludes through access to Ramp 44.

Ramp 44 – Ramp 45: (Ramp 44 to tip of Cape Point: 3.4 miles)
Status: ORV and pedestrian access is open from Ramp 44 south along the east side of Cape Point and west for through access to Ramp 45. The Interdunal Road and Ramp 45 are open to ORV and pedestrian access. Salt
Pond Road is open.

Ramp 45 – Ramp 49: (South Beach: 3.4 miles)
Status: Ramp 45 is open. There is ORV and pedestrian access 3.0 miles west of Ramp 45 where a full beach closure for a sea turtle nest protection area precludes through access to Ramp 49.

Ramp 49 – Ramp 55: (5.9 miles; includes Sandy Bay soundside parking area)
Status: The beach is open to ORV and pedestrian access for 0.3 of a mile northeast and 0.5 of a mile south of Ramp 49. There is pedestrian, but not ORV, access from the Frisco village line to 0.1 of a mile east of Ramp 55.

Ramp 55 – Hatteras Inlet: (Hatteras Inlet Spit: 2.2 miles)
Status: ORV and pedestrian access is open along the ocean shoreline from Ramp 55 south/west for 2.4 miles and approximately 0.3 of a mile west around the tip of Hatteras Inlet to the soundshore. The Pole Road is open to ORV and pedestrians. The Spur Road is open to ORV and pedestrians for soundside access. Cable Crossing is open with limited parking for ORVs and soundside access for pedestrians.

Ocracoke Island (20.5 miles of ocean shoreline)
Mileage Summary: 9.2 miles open to ORVs and pedestrians; 9.3 miles open to pedestrians only; 2.0 miles closed to public access due to resource closures.

Hatteras Inlet (North Ocracoke Spit) to Ramp 59: (1.4 miles)
Status: Access is open from Ramp 59 north to the inlet. ORV access is open along the ocean shoreline for 0.8 mile north of Ramp 59 and pedestrian access is open to the inlet shoreline.

Ramp 59 – Ramp 67: (7.8 miles)
Status: The beach is open for ORV and pedestrian access for 1.0 mile south and 0.9 of a mile north of Ramp 67 where a full beach closure for a sea turtle nest protection area precludes through ORV and pedestrian access. A total of approximately 6.3 miles of pedestrian access (via NC 12) is located between the two closures.

Ramp 67 – Ramp 70 (includes Ramp 68): (3.9 miles; includes Ramp 68)
Status: The beach is open for ORV and pedestrian access for 0.6 of a mile between Ramp 67 and Ramp 68. The beach is open for ORV and pedestrian access for 0.5 of a mile south of Ramp 68 and ORV access for 0.1 of a mile north of Ramp 70.

Ramp 70 – Ramp 72: (1.8 miles)
Status: The beach is open to ORV and pedestrian access for through access between Ramp 70 and Ramp 72.

Ramp 72 to South Point: (2.6 miles)
Status: The beach is open to ORV access for approximately 2.3 miles south and pedestrian access for approximately 2.5 miles south of Ramp 72.

Bodie Island (Ramp 1 to Oregon Inlet; 6.0 miles of ocean shoreline)
Mileage Summary: 2.6 miles open to ORVs and pedestrians; 1.4 miles open to pedestrians only; 2.0 miles closed to public access due to resource closures. Note: Green Island, southwest of Oregon Inlet bridge, is closed to public entry.

Status: Ramp 44 is open to ORV and pedestrian access south along the east side of Cape Point for approximately 1.0 mile and then west for approximately 0.3 of a mile. The Interdunal Road and Ramp 45 are open to ORV and pedestrian access. ORV and pedestrian access is open 0.2 of a mile east of Ramp 45. Salt Pond Road is closed.

Ramp 45 – Ramp 49: (South Beach: 3.4 miles)

Status: The beach is open for ORV and pedestrian access for 1.0 mile south and 1.1 miles north of Ramp 67 where a full beach closure precludes through ORV and pedestrian access. The beach is open for pedestrian access for 2.7 miles south of Ramp 59 and 3.7 miles north of Ramp 67. A total of approximately 6.4 miles of pedestrian access (via NC 12) is located between the two closures.

Ramp 67 – Ramp 70 (includes Ramp 68): (3.9 miles; includes Ramp 68)
Status: The beach is open for ORV and pedestrian access for 0.6 of a mile between Ramp 67 and Ramp 68. The beach is open for ORV and pedestrian access for 0.5 of a mile south of Ramp 68 and ORV access for .04 of a mile north of Ramp 70.

Ramp 70 – Ramp 72: (1.8 miles)
Status: The beach is open to ORV and pedestrian access for 1.7 miles south of Ramp 70 and 0.1 of a mile north of Ramp 72 where a sea turtle nest protection area precludes through access.

Ramp 72 to South Point: (2.6 miles)
Status: The beach is open to ORV and pedestrian access for approximately 2.3 miles south of Ramp 72.

Resource report

Piping plover – 10 fledged chicks total, Bodie Island, Cape Point and South Point.

American oystercatcher – Two single-chick broods remain at Bodie-Hatteras. Ten chicks have vledged at Bodie-Hatteras, nine at Hatteras, seven at Ocracoke. Twenty-eight have fledged so far in all districts combined.

Cape Hatteras National Seashore’s beach access report for July 28 is announced by the National Park Service as follows:

Status: The beach is open for ORV and pedestrian access for 0.6 of a mile between Ramp 67 and Ramp 68. The beach is open for ORV and pedestrian access for 0.5 of a mile south of Ramp 68 and ORV access for .04 of a mile north of Ramp 70.

Ramp 70 – Ramp 72: (1.8 miles)

American oystercatcher: Thee broods and 27 fledged chicks -three broods and nine fledged chicks at Bodie-Hatteras District, nine fledged chicks at Hatteras and nine fledged chicks at Ocracoke.

Colonial waterbirds – Bodie Spit active with nests, chicks and fledglings as well as Hatteras and Ocracoke.

Loggerheads -So far this season, there have been 127 nests observed and two have hatched. Currently there is one nest is at Bodie-Hatteras, 11 at Hatteras, one at Ocracoke

There were no mammal strandings this past week. There were 16 pedestrian intrusions, three dogs and one ORV intrusion..

Cape Hatteras National Seashore announces its beach access report for July 21 as follows:

Bodie Island (Ramp 1 to Oregon Inlet; 6.0 miles of ocean shoreline)
Mileage Summary: 2.6 miles open to ORVs and pedestrians; 1.4 miles open to pedestrians only; 2.0 miles closed to public access due to resource closures. Note: Green Island, southwest of Oregon Inlet bridge, is closed to public entry.

Ramp 1 – Ramp 2 (Coquina Beach Area) (1.2 miles)
Status: The beach is open for pedestrian access, but not for ORV access.

Ramp 2 – Ramp 4 (2.4 miles)
Status: Ramp 2 is closed for ORV access. North of Ramp 4, the beach is open for ORV and pedestrian access for approximately 2.4 miles.

Ramp 4 – Oregon Inlet (Bodie Island Spit: 2.0 miles)
Status: The beach is open to ORV and pedestrian access south of Ramp 4 for approximately 0.3 of a mile. A pedestrian only corridor extends south for an additional 0.2 of a mile of oceanside access. A resource closure on the ocean shoreline precludes RV and pedestrian access to Oregon Inlet. Two previously established “limited access” areas around the tip of and along the shore of Bodie Spit are now closed to public entry due to piping plover chick activity.

Hatteras Island (Ramp 23 South to Hatteras Inlet; 42.8 miles of oceanshoreline)
Mileage Summary: 21.4 miles open to ORVs and pedestrians; 17 miles open to pedestrians only; 4.4 miles closed to public access due to resource closures.

Villages of Rodanthe, Waves, and Salvo – Ramp 23: (Pea Island NWR boundary to Ramp 23 – 3 miles)
Status: The beach in front of the villages of Rodanthe, Waves and Salvo is closed to ORV access. The annual seasonal village closure is in effect from May 15 through September 15, 2011. The beach in front of the villages is open for pedestrian access for 3.0 miles. A resource closure located 0.1 of a mile north of Ramp 23 precludes ORV access to the north.

Ramp 23 – Ramp 27: (4.3 miles)
Status: The beach is open to ORV and pedestrian access for 3.9 miles south of Ramp 23.

Ramp 27 – Ramp 30: (2.1 miles)
Status: Ramp 27 is closed to ORV access and pedestrian access. There is ORV and pedestrian access for 1.1 miles north of Ramp 30.

Ramp 30 – Ramp 34: (4.3 miles)
Status: The beach is open to ORV and pedestrian access for 4.1 miles south of Ramp 30. A full beach closure for a sea turtle nest protection area located 0.2 of a mile north of Ramp 34 precludes through ORV and pedestrian access.

Ramp 34 – Ramp 38: (3.9 miles)
Status: The beach in front of Avon Village is closed to ORV access. The annual seasonal village closure is in effect from May 15 through September 15, 2011. The beach in front of Avon Village is open for pedestrian access for 3.9 miles.

Ramp 38 – Ramp 43: (6.0 miles)
Status: The beach is open to ORV and pedestrian access for 2.1 miles south of Ramp 38 and 0.4 of a mile north of Ramp 43. There is pedestrian access 1.0 mile north of Buxton Village and from Buxton Village beaches south for approximately 2.8 miles to Ramp 43.

Ramp 43 – Ramp 44: (0.4 of a mile)
Status: The beach is open to ORV and pedestrian access south to Ramp 44.

Ramp 44 – Ramp 45: (Ramp 44 to tip of Cape Point: 3.4 miles)
Status: Ramp 44 is open to ORV and pedestrian access south along the east side of Cape Point for approximately 1.0 mile and then west for approximately 0.2 of a mile. The Interdunal Road and Ramp 45 are open to ORV and pedestrian access. ORV and pedestrian access is open 0.2 of a mile east of Ramp 45. Salt Pond Road is closed.
Ramp 45 – Ramp 49: (South Beach: 3.4 miles)
Status: Ramp 45 is open. There is ORV and pedestrian access 0.3 of a mile west of Ramp 45. There is no through access between Ramp 45 and Ramp 49.

Ramp 49 – Ramp 55: (5.9 miles; includes Sandy Bay soundside parking area)
Status: The beach is open to ORV and pedestrian access for 1.7 miles northeast and 0.3 of a miles south of Ramp 49. There is pedestrian, but not ORV, access from the Frisco village line to 0.1 of a mile east of Ramp 55.

Ramp 55 – Hatteras Inlet: (Hatteras Inlet Spit: 2.2 miles)
Status: ORV and pedestrian access is open along the ocean shoreline from Ramp 55 south/west for 2.4 miles and approximately 0.3 of a mile west around the tip of Hatteras Inlet to the soundshore. The Pole Road is open to ORV and pedestrians. The Spur Road is open to ORV and pedestrians for soundside access. Cable Crossing is open with limited parking for ORVs and soundside access for pedestrians.

Ocracoke Island (20.5 miles of ocean shoreline)
Mileage Summary: 6.6 miles open to ORVs and pedestrians; 7.7 miles open to pedestrians only; 6.1 miles closed to public access due to resource closures.

Hatteras Inlet (North Ocracoke Spit) to Ramp 59: (1.4 miles)
Status: Ramp 59 is open to ORV and pedestrian access for 0.2 of a mile north of the ramp. A resource closure precludes access to north Ocracoke Inlet.

Ramp 59 – Ramp 67: (7.8 miles)
Status: The beach is open for ORV and pedestrian access for 1.0 mile south and 1.1 miles north of Ramp 67 where a full beach closure precludes through ORV and pedestrian access. The beach is open for pedestrian access for 2.7 miles south of Ramp 59 and 3.7 miles north of Ramp 67. A total of approximately 6.4 miles of pedestrian access (via NC 12) is located between the two closures.

Ramp 67 – Ramp 70 (includes Ramp 68): (3.9 miles; includes Ramp 68)
Status: The beach is open for ORV and pedestrian access for 0.6 of a mile between Ramp 67 and Ramp 68. The beach is open for ORV and pedestrian access for 0.5 of a mile south of Ramp 68 and ORV access for .04 of a mile north of Ramp 70.

Ramp 70 – Ramp 72: (1.8 miles)
Status: The beach is open to ORV and pedestrian access for 1.7 miles south of Ramp 70 and 0.1 of a mile north of Ramp 72 where a sea turtle nest protection area precludes through access.

Ramp 72 to South Point: (2.6 miles)
Status: The beach is open to ORV and pedestrian access for 0.9 of a mile south of Ramp 72 where a resource protection closure precludes access to the inlet.

Cape Hatteras National Seashore announces its beach access report for July 14 as follows:

Bodie Island (Ramp 1 to Oregon Inlet; 6.0 miles of ocean shoreline)
Mileage Summary: 2.6 miles open to ORVs and pedestrians; 1.4 miles open to pedestrians only; 0.6 of a mile of limited access; 1.4 of a mile closed to public access due to resource closures. Note: Green Island, southwest of Oregon Inlet bridge, is closed to public entry.

Ramp 1 – Ramp 2 (Coquina Beach Area) (1.2 miles)
Status: The beach is open for pedestrian access, but not for ORV
access.

Ramp 2 – Ramp 4 (2.4 miles)
Status: Ramp 2 is closed for ORV access. North of Ramp 4, the beach is open for ORV and pedestrian access for approximately 2.4 miles.

Ramp 4 – Oregon Inlet (Bodie Island Spit: 2.0 miles)
Status: The beach is open to ORV and pedestrian access south of Ramp 4 for approximately 0.3 of a mile. A pedestrian only corridor extends south for an additional 0.2 of a mile of oceanside access. A resource closure on the ocean shoreline precludes ORV and pedestrian access to Oregon Inlet. South of the closure there are two “limited access” areas (south of the resource closure to the inlet and along the western shoreline near the bridge) for a total of approximately 0.6 of a mile for pedestrian only, accessible by boat.

Hatteras Island (Ramp 23 South to Hatteras Inlet; 42.8 miles of ocean shoreline)
Mileage Summary: 17.3 miles open to ORVs and pedestrians; 17.4 miles open to pedestrians only; 2.2 miles of “limited access”; 5.9 miles closed to public access due to resource closures.

Villages of Rodanthe, Waves, and Salvo – Ramp 23: (Pea Island NWR boundary to Ramp 23 – 3.0 miles)

Ramp 30 – Ramp 34: (4.3 miles)
Status: The beach is open to ORV and pedestrian access for 4.3 miles south of Ramp 30.

Ramp 34 – Ramp 38: (3.9 miles)
Status: The beach in front of Avon Village is closed to ORV access. The annual seasonal village closure is in effect from May 15 through
September 15, 2011. The beach in front of Avon Village is open for pedestrian access for 3.9 miles.

Ramp 38 – Ramp 43: (6.0 miles)
Status: The beach is open to ORV and pedestrian access for 2.1 miles south of Ramp 38 and 0.4 of a mile north of Ramp 43. There is pedestrian access 1.0 mile north of Buxton Village and from Buxton Village beaches south for approximately 2.8 miles to Ramp 43.

Ramp 43 – Ramp 44: (0.4 of a mile)
Status: The beach is open to ORV and pedestrian access south to Ramp
 4.

Ramp 44 – Ramp 45: (Ramp 44 to tip of Cape Point: 3.4 miles)
Status: Ramp 44 is open to ORV and pedestrian access south for approximately 0.8 of a mile. From there, a pedestrian corridor
continues south to and around the tip of Cape Point for shoreline access. The Interdunal Road and Ramp 45 are open to ORV and pedestrian access. ORV and pedestrian access is open 0.2 of a mile east of Ramp 45. Salt Pond Road is closed.

Ramp 45 – Ramp 49: (South Beach: 3.4 miles)
Status: Ramp 45 is open. There is ORV and pedestrian access 0.3 of a mile west of Ramp 45. There is no through access between Ramp 45 and Ramp 49.

Ramp 49 – Ramp 55: (5.9 miles; includes Sandy Bay soundside parking area)
Status: The beach is open to ORV and pedestrian access for 1.7 miles northeast and 1.2 miles south of Ramp 49. There is pedestrian, but not ORV, access from the Frisco village line to 0.1 of a mile east of Ramp 55.

Ramp 55 – Hatteras Inlet: (Hatteras Inlet Spit: 2.2 miles)
Status: ORV and pedestrian access is open along the ocean shoreline from Ramp 55 south/west for 2.0 miles. The Pole Road is open to ORV and pedestrians. The Spur Road is open to ORV and pedestrians for soundside access. Cable Crossing is open with limited parking for ORVs and soundside access for pedestrians.

Ocracoke Island (20.5 miles of ocean shoreline)
Mileage Summary: 6.6 miles open to ORVs and pedestrians; 7.4 miles open to pedestrians only; 6.5 miles closed to public access due to resource closures.

Hatteras Inlet (North Ocracoke Spit) to Ramp 59: (1.4 miles)
Status: Ramp 59 is open to ORV and pedestrian access for 0.2 of a mile north of the ramp. A resource closure precludes access to North Ocracoke Inlet.

Ramp 59 – Ramp 67: (7.8 miles)
Status: The beach is open for ORV and pedestrian access for 1.0 mile south and 1.1 miles north of Ramp 67 where a full beach closure precludes through ORV and pedestrian access. The beach is open for pedestrian access for 2.7 miles south of Ramp 59 and 3.7 miles north of Ramp 67. A total of approximately 6.4 miles of pedestrian access (via NC 12) is located between the two closures.

Ramp 67 – Ramp 70 (includes Ramp 68): (3.9 miles; includes Ramp 68)
Status: The beach is open for ORV and pedestrian access for 0.6 of a mile between Ramp 67 and Ramp 68. The beach is open for ORV and pedestrian access for 0.5 of a mile south of Ramp 68 and ORV access for .04 of a mile north of Ramp 70.

Ramp 70 – Ramp 72: (1.8 miles)
Status: The beach is open to ORV and pedestrian access.

Ramp 72 to South Point: (2.6 miles)
Status: The beach is open to ORV and pedestrian access for 0.9 of a mile south of Ramp 72 where a resource protection closure precludes access to the inlet.

The National Park Service (NPS) announces that the Notice of Proposed Rulemaking for the management of off-road vehicle (ORV) use at Cape Hatteras National Seashore has been published in the Federal Register (FR). The FR Notice officially initiates the 60-day public comment period on the proposed rule.

The NPS proposes to designate routes where off-road vehicles (ORVs) may be used within Cape Hatteras National Seashore (Seashore), North Carolina. Under NPS general regulations, the operation of motor vehicles off of roads within areas of the national park system is prohibited unless otherwise provided for by special regulation. The proposed rule would
manage ORV use at the Seashore to protect and preserve natural and cultural resources and natural processes, and provide a variety of safe visitor experiences while minimizing conflicts among various users. The details of potential beneficial and adverse economic effects of the proposed rule can be found in the report entitled “Benefit-Cost Analysis of Proposed ORV Use
Regulations in Cape Hatteras National Seashore” which is available online at http://www.parkplanning.nps.gov/caha.

The public comment period will be open for 60 days. Comments must be received on or before midnight (Eastern Daylight Time) on Tuesday, September 6, 2011. The NPS does not anticipate extending the public comment period beyond September 6 due to a court deadline for completing the final rule.
